Actress Ha Na-Kyung claimed she was unaware of her partner's marital status when they started dating, but the court sided with the plaintiff. So what could be the reason behind this verdict?

The Busan District Court Eastern Division Civil Single Bench ordered Hana Kyung to pay 15 million KRW to the plaintiff, identified as "A", in a compensation lawsuit for infidelity brought against her on the 18th.

According to the judgment obtained by OSEN on July 23 (KST), the court held that "A third party should not interfere with someone else's marital cohabitation. A third party's illicit act with one side of the couple, causing mental distress to the spouse, can fundamentally constitute an unlawful act. Given the facts admitted earlier, it is reasonable to say that the defendant (Ha Na-Kyung) carried out an illicit act knowing that 'B' was married. Therefore, the defendant is obliged to compensate the plaintiff (A) for the mental distress caused by this."

It also stated that "the defendant argues that she had a sexual relationship with 'B' without knowing that he was married, and after learning about his marital status around April 12, 2022, she only contacted him to get back the borrowed money and discuss the pregnancy resolution, but did not commit an illicit act. However, even according to the defendant's claim, after learning that 'B' was married, she spent time with him and appeared to have had sex. Even looking at the content of the quarrel between the defendant and 'B' around May 2, 2022, it is judged that the defendant did not try to break up with 'B' immediately after knowing he was married, but intended to maintain the relationship and had a quarrel over the issue of maintaining the pregnancy."

The court decided that "referring to various circumstances such as the plaintiff's marriage period, the period of infidelity, and the plaintiff's significant mental shock when the defendant revealed her relationship with 'B', the amount of compensation the defendant should pay to the plaintiff is set at 15 million KRW."

Meanwhile, Ha Na-Kyung stated through her YouTube community, "The other party couldn't even prove to the court that I knew he was married. I was deceived by a scammer man, spent all my money and haven't got it all back yet. I'm truly wronged. I was fooled, lent money, and was only exploited. I told A everything as I thought we were both victims, not because I told him to sue. A is tormenting me with malicious lies without evidence, and I've filed an appeal and I intend to clear my name to the end."
