The verdict of the appeal trial for composer Don Spike (real name Kim Min-soo), who received a suspended sentence in the first trial for charges of using Philopon, will be delivered today (June 15th, KST).

The 3rd Criminal Division of the Seoul High Court (Presiding Judge Lee Chang-hyeong) will conduct the appeal trial for Don Spike, who has been indicted on charges of violating the Act on Special Measures for the Control of Narcotic Drugs, etc. on the morning of the 15th.

Don Spike is accused of purchasing approximately $45,000 worth of Philopon on nine separate occasions from late 2021 to September last year, and using it 14 times in hotels and party rooms in the Gangnam area.

In the first trial held last January, the court sentenced Don Spike to three years in prison with a five-year suspension of execution. The prosecution appealed the sentence on the grounds of its inappropriateness.

In the second trial of the appeal held in May, the prosecution pointed out, "His attitude after the crime is poor and the risk of recidivism is high," and demanded the same five-year prison sentence as in the first trial.

In his final statement on the day, Don Spike pleaded, "I am at fault and have no room for excuses. I am genuinely remorseful for the extensive impact of my actions. I will recover from addiction, avoid reoffending, and set a good example in society. I sincerely apologize," appealing for leniency.

Meanwhile, it was shocking to find out that Don Spike had a criminal record. After his drug charges came to light, it was revealed that in 2010, he was fined $5,000 for marijuana smoking charges and received a one-year prison sentence with a two-year suspension for separate drug-related charges in October of the same year.
